We may correct or update website content when necessary. Any correction affecting an existing order or concluded sales contract will be handled in accordance with applicable law. Nothing in this section limits our responsibility for inaccurate pre-contract information or goods that do not conform to the sales contract.

04Modifications To Services And Prices

Product prices, promotions, product ranges, and website features may be changed for future purchases without advance notice, subject to applicable law.

A price change will not alter the agreed price under a sales contract already concluded, except where the law permits a change or the parties validly agree otherwise.

05Products, Delivery, Returns, And Exchanges

Certain products or services may be available exclusively online, in limited quantities, or for limited periods. KRESCEND may impose reasonable purchase limits, including limits designed to prevent fraudulent ordering, abusive purchasing, or unauthorized bulk resale, subject to applicable law.

We make reasonable efforts to present product descriptions and images accurately. Screen settings may affect how colors appear. Minor variations do not necessarily amount to defects, but nothing in these Terms limits consumer remedies where goods fail to conform to the sales contract.

Products, availability, and future prices may be modified or discontinued without notice, subject to our obligations under existing sales contracts.

Refunds and exchanges. KRESCEND does not offer voluntary product exchanges. Cancellations, withdrawals, returns, and refunds are governed by our Refund & Return Policy and applicable law. This does not limit statutory remedies, including repair or replacement where legally required.

Change-of-mind return shipping. For eligible customer-initiated returns due to a change of mind, including returns under the statutory 14-day right of withdrawal, the customer is responsible for 100% of the direct cost of returning the goods, provided that this responsibility was disclosed before purchase. This applies equally to orders originally purchased with paid, discounted, or free outbound shipping. It does not apply where the return cost must be borne by KRESCEND under applicable law, including qualifying claims involving non-conforming goods.

Original delivery charges and shipping discounts. Delivery is a paid service, although KRESCEND may partially or fully subsidize outbound shipping through discounts or free-shipping promotions. The charges payable by the customer are shown at checkout. In the event of a statutory withdrawal, original standard delivery charges paid by the customer will be reimbursed to the extent required by law. A delivery discount funded by KRESCEND will not be retrospectively charged to the customer solely because a statutory withdrawal is exercised.

Product-specific and pre-order information. Where a product is offered for pre-order or with a special fulfillment schedule, the applicable product listing and information provided before checkout will identify the relevant estimated availability or dispatch terms. Estimates are not guarantees unless expressly agreed as binding. Any delay or inability to fulfill an order will be handled under applicable consumer law and the policies communicated before purchase.

Customers are encouraged to report a delivery delay within four days after the estimated delivery date. This is a recommended reporting period only and does not limit statutory rights relating to delayed, lost, or undelivered orders.

06Orders, Billing, And Account Information

KRESCEND reserves the right to review, limit, reject, or, where legally permitted, cancel orders for legitimate reasons, including suspected fraud, unauthorized transactions, inaccurate information, stock unavailability, abusive purchasing practices, manifest pricing errors, and attempts to circumvent published purchase limits.

Order restrictions may apply across orders associated with the same customer account, payment method, billing address, or shipping address where reasonably necessary. Decisions will be made on an objective basis and in compliance with applicable law.

Where we are unable to fulfill a paid order and the order is cancelled by KRESCEND, we will refund the payments attributable to the cancelled order, including applicable delivery charges, in accordance with our Refund & Return Policy and applicable law. We will make reasonable efforts to notify the customer using the contact details supplied with the order.

The placement, acknowledgement, and acceptance of an order, and the time at which a sales contract is concluded, are determined by the information presented during checkout, the order communications, and applicable law. An automatically generated acknowledgement of receipt does not, by itself, override any contractual information expressly communicated at checkout.

You agree to provide complete and accurate billing, shipping, contact, and account information and to update it where necessary. Additional shipping or re-delivery costs directly attributable to customer-provided errors, refusal of delivery, or failure to collect a parcel may be charged where reasonably documented and legally permissible.

We may require reasonable verification before dispatching an order when necessary to prevent fraud or unauthorized transactions. Such verification will be handled in accordance with our Privacy Policy and applicable law.

07Optional Third-Party Tools

If KRESCEND lawfully cancels a paid order, we will issue the refund required by the Refund & Return Policy and applicable law.

We are not responsible for delivery problems solely attributable to such customer conduct, except to the extent that applicable law provides otherwise.

Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded, including statutory rights and remedies relating to non-conforming goods, defective products, incorrect delivery, or other mandatory consumer protections. Nothing in these Terms excludes liability for intentional wrongdoing or other liability that cannot be limited by law.

14Customer Responsibility And Indemnification

You are responsible for unlawful conduct, intentional misuse of the website, infringements of third-party rights, and materially false information you provide, to the extent established under applicable law.

Where your unlawful or culpable conduct directly causes KRESCEND a demonstrable loss or a valid third-party claim, KRESCEND reserves the right to pursue compensation or other remedies to the extent available under applicable law.

This section does not impose automatic, unlimited indemnification obligations on consumers, does not require payment of legal fees that are not recoverable under applicable law, and does not restrict statutory consumer rights.

15Severability

If a provision of these Terms is found invalid, unlawful, or unenforceable, that provision will be ineffective to the extent required by law. The remaining provisions will continue to apply insofar as they can operate lawfully and consistently with the purpose of these Terms.

16Termination And Suspension

KRESCEND may suspend or terminate access to website accounts or features for legitimate reasons, including serious violations of these Terms, suspected fraud, security risks, or unlawful conduct, subject to applicable law and any notice requirements.

Termination of website access does not by itself cancel a legally binding sales contract, remove accrued payment obligations, or eliminate mandatory consumer rights and remedies relating to previous purchases.

17Entire Agreement; Relationship Between Policies

These Terms, together with the policies and product-specific terms properly incorporated into the purchase process, govern the relevant contractual relationship between the customer and KRESCEND, subject to mandatory law. Failure to enforce a provision on one occasion does not necessarily waive the right to enforce it later.

If these Terms conflict with the Refund & Return Policy on cancellations, statutory withdrawals, returns, return shipping costs, or refunds, the Refund & Return Policy governs those matters, subject to applicable law.

The Shipping Policy governs shipping methods, delivery information, and shipping charges payable at checkout. Any country-specific outbound shipping reference rates published in our Refund & Return Policy are provided for informational purposes and do not represent return shipping charges. The Refund & Return Policy governs cancellations, withdrawals, refunds, and the allocation of return shipping costs, subject to applicable law.

These Terms govern the remaining aspects of website use and the sales relationship.

Nothing in these Terms or related policies reduces mandatory statutory consumer rights. Any unclear provision will be interpreted according to applicable consumer protection law.

18Governing Law

These Terms and the relevant sales contracts are governed by the laws of Poland, subject to applicable rules on the law governing consumer contracts.

Where KRESCEND directs its activities to consumers in other countries, this choice of law does not deprive consumers of mandatory protections afforded by the laws of their country of habitual residence where those protections apply.

The current version of these Terms will be published on our website. KRESCEND may update these Terms from time to time for legal, technical, security, or operational reasons.

Changes will apply to future website use and orders to the extent permitted by applicable law and after any required notice. Changes will not retroactively alter the terms of a previously concluded sales contract unless expressly agreed and legally permitted.

Continued use of website features after a lawful change may constitute acceptance of updated website-use terms where applicable, but will not remove rights arising from an existing purchase.
